{"id":23777,"date":"2023-08-31T10:22:06","date_gmt":"2023-08-31T10:22:06","guid":{"rendered":"https:\/\/www.cassana-inmobiliaria.com\/?p=23777"},"modified":"2023-08-31T10:22:10","modified_gmt":"2023-08-31T10:22:10","slug":"the-law-for-the-right-to-housing-enters-into-force","status":"publish","type":"post","link":"https:\/\/www.cassana-inmobiliaria.com\/en\/the-law-for-the-right-to-housing-enters-into-force\/","title":{"rendered":"THE LAW FOR THE RIGHT TO HOUSING ENTERS INTO FORCE."},"content":{"rendered":"\n<p><strong>On May 25, the Law for the right to housing was published in the BOE, which came into force the following day, May 26.<\/strong><\/p>\n\n\n\n<p>The aforementioned law, which entered into force two days\nbefore the municipal elections, has -among others- the following objectives:<\/p>\n\n\n\n<p>\u2212\u2002Establish a basic regulation of the rights and duties of\ncitizens in relation to housing, as well as those associated with home\nownership.<\/p>\n\n\n\n<p>\u2212\u2002Facilitate access to decent and adequate housing for\npeople who have difficulties accessing housing under market conditions, paying\nspecial attention to young people and vulnerable groups.<\/p>\n\n\n\n<p>\u2212\u2002Provide effective instruments to ensure the functionality,\nsafety, universal accessibility and habitability of homes.<\/p>\n\n\n\n<p>\u2212\u2002Define the fundamental aspects of state planning and\nprogramming in the field of housing, in order to favor the exercise of\nconstitutional law throughout the territory.<\/p>\n\n\n\n<p>\u2212\u2002Regulate the basic legal regime of public housing parks,\nensuring their development, protection and efficiency to serve those sectors of\nthe population with greater access difficulties.<\/p>\n\n\n\n<p>&nbsp;One of the most\noutstanding aspects of this Law, directly related to the rental of flats and\nhomes, is that the autonomous communities that so wish may initiate the\nprocedure for the declaration of price-stressed areas, although a state index\nmust be set up to rent control of flats and houses. Following the results of\nthe regional elections on May 28, several regional presidents have publicly\nstated that they will not initiate these procedures as they disagree with the\ncontent of said measure. For this reason, said measure (one of the most\noutstanding of the Law) will foreseeably have to wait months to become a\nreality. In order for said measure to be applied, a territorial government must\nagree with the Ministry of Transport, Mobility and Urban Agenda, which\ncoordinates housing policies at the state level, the establishment of a\nstressed area; In this, limits may be established on the monthly rental income.\nBut it will be done only on the new flat rental contracts and not on the\ncontracts that are already in force. In addition, to set the price ceilings for\nrenting flats for large holders (those with more than 10 flats or homes, or\nmore than 5 if they are all within the stressed area and the autonomous\ncommunity justifies the need to lower the general limit ) it will be necessary\nto have a rental price index that is a reference. The Ministry of Transport is\nreforming the one it already has because it does not respond to the needs\nimposed by the new standard. For small owners, who are the majority of landlords\nin the Spanish apartment and home rental market, prices will be limited based\non the previous contract. These may also have new tax incentives, although\nthese are the only part of the law that will not come into force until January\n1, 2024. Finally, it is worth highlighting the ceilings on renewals of rental\ncontracts for flats and homes. The Law provides that the rental income may not\nincrease more than 2% during the year 2023 and may not increase more than 3%\nduring the year 2024.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On May 25, the Law for the right to housing was published in the BOE, which came into force the following day, May 26.
